These terms and conditions apply to the “MUNCH PayTM Cashback Promo” (hereinafter referred to as “Program") for consumers purchasing the MUNCH Nuts 32g pack worth MRP Rs. 20/- that carries the communication regarding this offer (hereinafter referred to as “Program Product") sponsored by Nestlé India Limited and conducted & managed by Qwikcilver Solutions Private Limited (hereinafter referred to as “Organizer”) wherein consumers can avail assured cashback of Rs. 10/-, or stand a chance to redeem a cashback of Rs. 20/- or Rs. 40/- cash back on PayTm Desktop web/mobile webpage on Android or iOS (hereinafter referred to as PayTM website) by complying with the following terms and conditions:
- The consumer needs to find the unique 9 digit alphanumeric code inside the Program Product to obtain a link (hereinafter referred to as “link"). The consumer can use this link to avail up to Rs. 40/- cash back from the PayTM mobile webpage/website.
- Consumers participating or seeking to participate in the program shall individually be referred to as "Participant" and collectively as "Participants”.
- Participation in this Program is purely voluntary and optional. This Offer is not valid in conjunction with any other Offer. Products also available without this Offer. By participating in this Offer, each participant is deemed to have accepted these terms and conditions. This offer is not valid in the state of Tamil Nadu.
- This Program is being conducted by the Organizer and sponsored by Nestle India Limited during the Program Period defined hereinafter.
- A Consumer who sends the unique code mentioned inside the Program Product, between 01.02.2021 to 15.04.2021 (hereinafter referred to as the “Program Period”), will get a Paytm code and link to redeem a assured cashback of Rs. 10/- or stands a chance to redeem a cashback of Rs. 20/- or Rs. 40/- on the PayTM website on a transaction of a utility bill payment or recharge transactions, with minimum transaction value of INR 48/-. The user has to complete the transaction and before payment, enter the promo code received via SMS in the ‘Have a promo code?’ section. Cashback will be credited in the UPI linked account of the Participant within 24 hours. If the user does not have an associated Bank account during recharge/bill payment, user can do so within 7 days. Paytm will attempt to transfer cashback to an associated bank account for 7 days, post which the cashback will be sent to user's Paytm Gift Voucher Balance.
- How to Redeem
- Find 9 digit unique code inside Munch pack.
- To register, SMS MUNCHNNUTS <SPACE> 9 digit unique code to 8367283672. Valid entry will get Paytm code and link via SMS of the denomination they have won. Note : One phone number can avail the offer 2 times during the promo period, but only one time in a calendar month. More than 2 SMS sent from the same mobile number within a calendar month, will be considered as invalid
- Process to redeem promo code:-
- Click on the Paytm link received via SMS (the SMS will also include the denomination of the Cashback won)
- The Paytm website or mobile webpage will open directly
- Choose Utility bill payment/Mobile recharge
- Complete a transaction of minimum Rs. 48/-
- Before payment, enter the Paytm code received via SMS in the ‘Have a promo code?’ section
- The cashback will be credited to your UPI linked account within 24 hours
- This Offer is valid only in India except the state of Tamil Nadu. The Offer is valid for the citizens of India (except the employees and family members of the Organizer and Nestle India Limited, their associate companies, their joint venture partners, its co-packers, their distributors, their agents, their advertising and Program agencies and their auditors.)
- Paytm cashback is the term used to define Paytm cash. The cashback is deposited in the UPI linked back account of the Participant when he/she completes a utility bill/ mobile recharge transaction on Paytm mobile webpage/website of minimum Rs. 48/-. No cash would be given in lieu of Paytm cash.
- Each link can be used only once to redeem the Cashback.
- The participant will receive assured reward of INR 10. Other denominations are INR 20 and 40. The denomination of the cashback will be randomly (scientific randomizer) allocated by the organizer.
- This Offer can be availed only 2 times (but only once during a calendar month) by each Participant using a single PayTM Account during the Program Period. Any Participant, using a link more than 2 times from a single PayTM Account, will not be eligible for availing the PayTM Cashback.
- The code & link will be valid till the end of the promotion period. The link cannot be redeemed after the expiry of the Program Period and the participant by participating in the Program agrees to waive off right of redemption post the date of expiry of the Program Period.
- In case of any conflict between terms and conditions printed on the pack/insert/voucher and these Terms and Conditions on https://www.woohoo.in/cashbackpromo website, the terms and conditions provided/furnished on https://www.woohoo.in/cashbackpromo website, shall prevail.
- Paytm cashback offered as part of this Offer is non-transferrable, non-refundable; and no physical cash payment will be made in lieu of this. At any stage, Nestle India Limited, and/or Organizer reserve their right to call upon the Participant to submit any document for verification of identity as per its sole discretion.
- Nestle India Limited will not be liable for any delay in actual redemption under this Offer reflecting in the customers’ account.
- Organizer and Nestle India Limited will not be responsible for any loss or damage to the Code due to wrong opening of the pack.
- Under this Program, the links are being offered directly by the Organizer. Nestlé India Limited is not responsible either directly or indirectly with respect to any matter pertaining to this Voucher and the prize offered with this Voucher.
- Nestlé India Ltd does not endorse the quality of any of the products or services being offered by the Organizer. Any complaints or queries pertaining to the same would have to be taken up directly with the Organizer for the support on the product or service. - Nestle India Limited and/or Organizer reserves the right to cancel, change or substitute Offer at any time without any prior notice.
- The Participant/s undertake and irrevocably and unconditionally permit Nestle India Limited and/or the Organizers to cover the Program through various media including newspapers, radio television news channels, internet, point of sale materials, etc., and shall not raise any objection, protest or demur to such coverage or in this regard.
- The winners must, at the request of Nestle India Limited and/or the Organizers participate in all Program related activities (such as publicity and photography) surrounding the winning of the Prizes, free of charge, and they consent to the Organizers using their name and image in the Program material.
- All rights, title and interest, including but not limited to the Intellectual Property Rights, in the Program material(s) and in any and all responses received shall vest with Nestle India Limited and or its partners respectively. Nestle India Limited or any person or entity permitted by Nestle India Limited in this regard shall be entitled to use the responses received or any information in connection with the entry in any media for future Program, marketing, publicity and any other purpose, without any permission and or payment to the Participant.
- All material submitted in connection with the Program (whether written, audio, electronic or visual form, or a combination of those) or any photographs, video and/or film footage and/or audio recording taken of Participants are assigned to Nestle India Limited upon submission and become the property of Nestle India Limited exclusively. Nestle India Limited may use the material in any medium in any reasonable manner it sees fit. Copyright in any such material remains the sole property of Nestle India Limited.
- By participating in the Program, Participant(s) confirms to waive the applicability of rules and regulations of the National Do Not Call Registry (hereinafter referred to as “DND”) and agree and give their consent to be contacted by Nestle India Limited and/or the Organizers for the purposes of this Program In case the customer finds a Program Product pack without code and files a complaint for the same or approaches the company with this complaint. In that case Nestle India Limited and/or the Organizers liability would be limited to providing the complainant with a new promo Code to enable him to participate in the Program as per this Terms and Conditions. The Participant cannot demand any monetary or other compensation for the same.
- Organizer/ Nestle India Limited accept no responsibility for any tax implications that may arise from the offer. Participants will have to bear incidental costs, if any, that may arise for redemption of the prize
- The Offer is being conducted under the supervision of independent auditors.
- Nestle India Limited and/or Organizers shall not be responsible for any loss, injury or any other liability arising out of the Program or due to participation by any person in the Offer.
- Nestle India Limited and/or Organizers shall not be responsible for downtime on the services, caused due to technicalities (like failure of hardware equipment, configuration issue, network congestion), or due to decisions/changes in regulations that are carried out by TRAI, RBI, DoT or any other regulatory body.
- Participant agrees that use of this Offer is at his/her sole risk. Nestle India Limited and/or the Organizer, their affiliates, and their officers, directors, employees, and agents disclaim all warranties, express or implied, including without limitation any warranty of merchantability, availability, and fitness for a particular purpose or non-infringement.
- The Organizers and /or Nestle India Limited shall not be liable to perform any of its/their respective obligations under the Program or in respect of the Cashback where it is unable to do so as a result of circumstances beyond its/their control in the nature of fire, explosions, natural calamities, state emergency, riots, or any other force majeure condition, etc., and shall not be liable to compensate the Participant in these circumstances. The Organizers and/or Nestle India Limited shall not be accountable/liable for any disruptions/stoppages/interruptions or cancellation of the Program due to any government restrictions.
- Failure to exercise or delay in exercising a right or remedy provided hereunder or by law does not constitute a waiver of the right or remedy or waiver of other rights or remedies on the part of the Organizers and Nestle India Limited.
- If a Participant is dissatisfied with the Program or the Program rules and/or any content or any requirements of the Program form, the materials available related thereto, or with these terms and conditions, his/her sole and exclusive remedy is to, not participate in the Program.
- The Organizers and Nestle India Limited shall under no circumstances be liable, whether jointly or severally, for any loss or damage suffered or sustained (including but not limited to consequential loss), including for personal injury or property damage suffered or sustained, as a result of participation in the Program.
- By entering the Program, the Participant hereby releases from and agrees to indemnify the Organizers and Nestle from and against all liability, cost, loss or expense arising out of participation in the Program including (but not limited to) personal injury and damage to property and whether direct, indirect, consequential, foreseeable, due to some negligent act or omission, or otherwise.
- The Participant shall be solely responsible for any consequences which may arise due to his/her participation in the Program by conducting an illegal act. Participant also undertakes to indemnify Nestle India Limited/the Organizers and/or their respective officers, directors, employees and agents on the happening of such an event (including without limitation cost of attorney, legal charges etc.) on full indemnity basis for any loss/damage suffered by the Organizers and/or Nestle India Limited on account of such act on the part of the Participant.
- In consideration of the Organizers and Nestle India Limited allowing the Participant/s to take part in the Program, to the maximum extent permitted by law, the Participant/s waive and release each and every right or claim, all actions, causes of actions (present or future) each of them has or may have against the Organizers and/or Nestle India Limited, their respective agents, directors, officers, business associates, group companies, sponsors, employees, or representatives for all and any injuries, accidents, or mishaps (whether known or unknown) or (whether anticipated or unanticipated) arising out of the Program.
- The terms and condition of this Offer shall be governed by Indian Laws. The Courts at Delhi shall have the exclusive jurisdiction in respect of all the subject matter with relation to the Offer.
- Any costs associated with entering the Program, including but not limited to accessing the Program website, SMS charges to enter into the Program, Call Charges, or Data Charges are the responsibility of each Participant. The Participant may be charged by their respective telecom operator as per their nominated tariff plan.

- Participants’ personal data as collected by NESTLÉ India’s associates/partners or affiliates shall pass your personal data to NESTLÉ India. Such data collected and retained may be used by NESTLÉ India and or its related associates/partners/ affiliates for marketing, internal study, and data analysis purposes.

- NESTLÉ INDIA LTD. and the Agency shall not be responsible for (including but not limited to):
- For any SPAM generated messages
- For the Operator Code not being displayed on the user's mobile phones
- For any SMS message delivery failures
- Any lost, late or misdirected computer transmission or network, electronic failures or any kind of any failure to receive entries owing to transmission failures or due to any technical reason
- If the participant has registered himself to the DND of the telecom provider/ the participant has registered with National Do Not Call Registry/ Participant has specifically requested for not receiving messages for the specific campaign
- Other conditions beyond its reasonable control
- NESTLÉ India/Agency shall not be liable for any failure to comply with its obligations mentioned herein, caused by weather conditions, fire, flood, hurricane, strike, war , riots, political unrest, civil commotion, terrorist attacks, or any other event amounting to Force Majeure and beyond their control.
- The Program is not available (void) where prohibited by any law. All relevant national and local laws apply. All disputes to be settled within the jurisdiction of the Courts in Delhi only.
- Mere participation in the Program does not entitle the participant to the prize(s) unless all other terms and conditions are fully met. Failure to comply with any of the terms and conditions hereof or any fraudulent conduct shall disentitle the participant
