zomato Offer T&CSteps to Redeem Terms & Conditions

Program Details, Concept and Participation:
1. These terms and conditions apply to SNICKERS zomato Program (hereinafter referred to as "Program") for voluntary participation of consumers, sponsored and launched by MARS INTERNATIONAL INDIA PVT. LTD., conducted by QwikCilver, Solutions Pvt. Ltd. having its office at No. 111, 1st floor, “Brigade Manae Court”, Industrial Layout, Koramangala 5th Block, Bangalore 560095 (hereinafter referred to as “Agency”) wherein consumers can participate by sending an SMS of the 9 Character alphanumeric Unique Code (herein referred to as the “Code”)printed inside Snickers pack of MRP 20 & MRP 40 (hereinafter referred to as the “Promo Pack”).
2. The Program is valid only in India from 01/03/2021 to 31/08/2021 (herein after referred as "Program Period"). The Program is valid throughout India. The Program is open to Citizens of India only.
3. During the Program Period, off up to ₹150 on zomato & Off up to ₹200 on zomato shall be given on purchase of Snickers MRP ₹20 & ₹40 respectively by participating with unique code.
4. The Program period starts from 1st March 2021 and shall be valid till 31st August 2021 (both days included). If the customer has bought a pack before 1st March 2021, then customer will not be eligible for participation in the Program until the start of Program Period (1st March 2021). All participation prior to the Program Period and after the end date of the Program Period will be considered as ineligible.
5. The Program is subject to all applicable central, state, and local laws and regulations.
6. Consumers participating or seeking to participate in the Program shall individually be referred to as "Participant" and collectively as "Participants".
7. Regular call and message rates will apply as per the consumer telecom operator in their respective circle.
8. The zomato Code can be used by new & existing zomato users.
9. Winner will have to log in to their zomato account/create a new account to be able to claim zomato code
10. MARS INTERNATIONAL INDIA PVT. LTD./ its Agency reserves right to cancel / amend / extend the Program Period without giving any notice/intimation. No claims/questions shall be entertained in this regard.
Agreement to Terms and Conditions:
1. By participating in this Program, Participants fully and unconditionally agree to and accept these Terms and Conditions available on www.woohoo.in/snickers (“Program Website") as well as the decisions of MARS INTERNATIONAL INDIA PVT. LTD., which are final and binding in all matters related to the Program. Successfully entering the Program and winning a prize is subject to fulfilment of all terms and conditions mentioned herein.
2. MARS INTERNATIONAL INDIA PVT. LTD. reserves the right to exclude any person from the Program on grounds of misconduct or criminal record.
3. MARS INTERNATIONAL INDIA PVT. LTD. reserves the right to terminate, modify or extend the Program, at any time at its absolute discretion, without assigning any reason. All decisions of MARS INTERNATIONAL INDIA PVT. LTD. in respect of the Program and the prizes therein will be final and binding.
4. If this Program is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of MARS INTERNATIONAL INDIA PVT. LTD. and/or its Agency, including but not limited to technical difficulties, unauthorized intervention or fraud, MARS INTERNATIONAL INDIA PVT. LTD. / Agency reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to invalidate any customer; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate, or cancel the Program, as appropriate.
5. If for any reason this Program is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorized intervention, technical failures or any other causes beyond the reasonable control of MARS INTERNATIONAL INDIA PVT. LTD. or the Agency, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Program, MARS INTERNATIONAL INDIA PVT. LTD. Reserves the right in its sole discretion to cancel, terminate, modify or suspend the Program. .
6. Rights to use data - By participating in this Program:
  - a. The participant expressly confirms and represents that he/she has read the Terms & Conditions of the Program on how to enter, and details on usage, collection, retention and sharing of personal data;
  - b. The participant agrees to be bound by the terms, those relating to the collection, retention, use and sharing of personal data; and
  - c. The participant confirms that he/ she has gone through MARS INTERNATIONAL INDIA PVT. LTD. Privacy Policy and that he/ she has no objection in collection or processing of their data according to the manner carved out in the privacy policy. The participant will also be governed by zomato Privacy Policy after being their registered users.
  - d. The Participant’s personal data as collected by MARS INTERNATIONAL INDIA PVT. LTD.’s associates/partners or affiliates shall be passed to MARS INTERNATIONAL INDIA PVT. LTD. The personal data shall be administered and treated under MARS INTERNATIONAL INDIA PVT. LTD. privacy and data collection guidelines. Such data collected and retained may be used by MARS INTERNATIONAL INDIA PVT. LTD. and or its related associates/partners/ affiliates for marketing, internal study, and data analysis purposes.
  - e. MARS INTERNATIONAL INDIA PVT. LTD. encourages participants to read the privacy notice of any such company before sharing personal data. If the Participant does not want his / her personal data to be collected by or shared with a company other than MARS INTERNATIONAL INDIA PVT. LTD. the Participant can always choose not to participate in such activity. If the Participant do opt-in to communications from such a company, remember that the Participant always have the right to opt-out and the Participant would need to contact that company directly to do so.
  - f. MARS INTERNATIONAL INDIA PVT. LTD. and the Agency shall not be responsible for (including but not limited to):
    - For any SPAM generated messages
    - For the Operator Code not being displayed on the user's mobile phones
    - For any SMS message delivery failures
    - - Any lost, late, or misdirected computer transmission or network, electronic failures, or any kind of any failure to receive entries owing to transmission failures or due to any technical reason
    - If the participant has registered himself to the DND of the telecom provider/ the participant has registered with National Do Not Call Registry/ Participant has specifically requested for not receiving messages for the specific campaign
    - Other conditions beyond its reasonable control
7. To avail the offer Winners will be subject to the T&Cs of zomato. The validity of zomato code will be till 31st Aug 2021.
Eligibility:
1. This Program will be open to all the residents of India except for employees, their immediate family members, agents, distributors, retailers and any other channel partner of MARS INTERNATIONAL INDIA Pvt. Ltd. and the Agency.
2. MARS INTERNATIONAL INDIA Pvt. Ltd. or the Agency will not be responsible for any NDNC (National Do Not Call) Registry regulation that will come into play. All Participants who participate will agree as per the terms and conditions that even if they are registered under NDNC, DND (Do Not Disturb), MARS INTERNATIONAL INDIA Pvt. Ltd. or the Agency will have all the authority to call such shortlisted winners by virtue of them having voluntarily participated in the Program.
Program Timings:
1. The Participants who send the valid and correct SMS between 12:00:01 AM to 11:59:59 PM (here in after referred as "Program Timings") during the Program Period are eligible to participate in the Program.
2. Time of participation will be defined as the time at which the entry is received through the SMS mode of participation at Agency’s computer system.
3. Entries coming outside the Program Period will not be considered for winner selection.
4. The Program is applicable on specific pack of Snickers Bars of 22GM & 45 GM
Prize :
1. No capping is applied on valid participation & Participant can win any number of zomato codes during the Program Period basis the valid participation.
2. Participants to receive Prizes of zomato code of off up to ₹150 & ₹200. The details are as below: -
  - Get up to ₹150 Off on a minimum order of ₹250 on zomato
    - New zomato users to get ₹100 discount & ₹50 cashback in zomato Wallet
    - Existing zomato users to get ₹55 discount & ₹25 cashback in zomato Wallet
    - Cashback will be credited post successful transaction on zomato
    - Cashback will be valid for 3 calendar dates
    - Each zomato code is applicable only once
    - zomato code is valid till 31st August 2021
  - Get up to ₹200 Off on a minimum order of ₹300 on zomato

How to Participate:
1. To participate in the Program, Participants are required to send an SMS:
  - As a first step, Participants are required to send a SMS with 9-character unique code printed inside the Promo Pack from any GSM or CDMA mobile phone in below format: -
    SNICKERS<SPACE>unique code no. to 7036185000
  - After sending SMS in a valid format, Participant to receive zomato code.
  - 1 Code can be redeemed only once during Promo Period. A Code shall only be valid for one-time participation.
  - Selection of Winner shall be subject to fulfilment of all terms and conditions of the Program.
Winner Selection:
1. A Participant can win any number of times basis the valid participation. A participation will be considered valid if SMS is sent in correct format (Accepted SMS Format is “SNICKERS<space> 9-character Alpha-numeric Code” on 7036185000) & SMS is sent during the Promo Period.
2. The Code cannot be redeemed after the expiry of the Promotion Period and the participant by participating in the Promotion agree to waive off right of redemption post the date of expiry of the Promotion Period.
3. Prizes will be given subject to the winner satisfying the verification process of MARS INTERNATIONAL INDIA PVT. LTD. or the Partner Agency.
4. MARS INTERNATIONAL INDIA PVT. LTD., and Partner Agency shall have a right to ask for the original packs in case of any query raised by the Participants during the Program Period, non – submission of which shall render the Participant as not eligible to participate in the Program.
5. Neither MARS INTERNATIONAL INDIA PVT. LTD. Nor Agency be liable for any delay in actual redemption under this Offer reflecting in the customers’ account.
6. MARS INTERNATIONAL INDIA PVT. LTD. Or its Agency shall not be responsible for any loss or damage to the Code due to wrong opening of the pack.
7. zomato Code as part of this Offer is non-transferrable, non-refundable; and no physical cash payment will be made in lieu of this. At any stage, MARS INTERNATIONAL INDIA PVT. LTD., and/or Organizer reserve their right to call upon the Participant to submit any document for verification of identity as per its sole discretion
8. MARS INTERNATIONAL INDIA Pvt. Ltd. & its Agency does not endorse the quality of any of the products or services being offered by zomato. Concierge Lines are open only from Monday to Friday between 10:30 am to 5:30 pm and are closed on weekends /public holidays including bank holidays.
9. The image of the prize depicted on the press ads/posters/TVC's/pack shots etc. are for illustrative purposes only and the actual prize may vary from the depiction made.
10. MARS INTERNATIONAL INDIA PVT. LTD. or its Agencies shall not be liable for any loss or damage of the prize due to Act of God, Governmental action, Force Majeure circumstances and / or any other reasons which are beyond the reasonable control of MARS INTERNATIONAL INDIA PRIVATE LIMITED / its Agency, and under no circumstances, MARS INTERNATIONAL INDIA PRIVATE LIMITED shall be liable to pay any compensation whatsoever for such losses.
How to Participate:
1. Participants will receive zomato Code on their registered mobile number within 24 business hours.
2. MARS INTERNATIONAL INDIA PVT. LTD. Or its agency at its discretion may ask the Winners to furnish the any or all the following documents:
  1. Election ID Card, Passport, Driving License, or similar Govt. ID.
  2. Participants will be required to retain & furnish on demand the wrapper of the pack with the winning code.
  3. Participant will be required to furnish a proof of ownership of participating mobile number (Mobile bill or a letter from their Telecom operator & service provider, clearly stating the mobile number, their name, address etc.)
  4. Identification details (Name) on the identification document furnished should match the same with Mobile Bill/Letter furnished by network service provider.
3. In case any one of the above documents are not available for any reason, MARS INTERNATIONAL INDIA PVT. LTD/Agency reserves the right to take a decision basis the availability of other documents. This decision will be final and binding.
Publicity:
- The Participant/s undertake and irrevocably and unconditionally permit MARS INTERNATIONAL INDIA PVT. LTD. to cover the Program through various media including newspapers, radio television news channels, internet, point of sale materials, etc., and shall not raise any objection, protest, or demur to such coverage or in this regard.
- The winners must, at the request of MARS INTERNATIONAL INDIA PVT. LTD., participate in all Program activity (such as publicity and photography) surrounding the winning of the prize, free of charge, and they consent to MARS INTERNATIONAL INDIA PVT. LTD. using their name and image in Program material.
Intellectual Property:
- All right, title, and interest, including but not limited to the Intellectual Property Rights, in the Program material(s) and in all responses received shall vest solely and exclusively with MARS INTERNATIONAL INDIA PVT. LTD.at all times. MARS INTERNATIONAL INDIA PVT. LTD. or any person or entity permitted by MARS INTERNATIONAL INDIA PVT. LTD. in this regard shall be entitled to use the responses received or any information in connection with the entry in any media for future Program, marketing, publicity, and any other purpose, without any permission and or payment to the Participant.
- All material submitted in connection with the Program (whether written, audio, electronic or visual form, or a combination of those) or any photographs, video and/or film footage and/or audio recording taken of Participants are assigned to MARS INTERNATIONAL INDIA PVT. LTD. upon submission and become the property of MARS INTERNATIONAL INDIA PVT. LTD. exclusively. MARS INTERNATIONAL INDIA PVT. LTD. may use the material in any medium in any reasonable manner it sees fit. Copyright in any such material remains the sole property of MARS INTERNATIONAL INDIA PVT. LTD.
General Conditions:
- Each Participant represents and warrants that he/she is legally competent to enter binding contracts under applicable laws. By taking part and/or entering the Program, the Participant warrants that all information provided by Participant regarding Participant's name, age, state, city, address, phone number, etc., is true, correct, accurate and complete.
- The decision of MARS INTERNATIONAL INDIA PVT. LTD. or its Agency, as regards the selection of winners and distribution of the prizes shall be final, subject only to MARS INTERNATIONAL INDIA PVT. LTD. approval. No correspondence or any other claims whatsoever, in this regard will be entertained.
- No queries, claims, dispute, complaints, or grievances shall be entertained by MARS INTERNATIONAL INDIA PVT. LTD. and its Agency after 15 days from the date of the closure of the Program.
- The prize cannot be exchanged and is not transferable and cannot be converted into cash.
- MARS INTERNATIONAL INDIA PVT. LTD. reserves the right to change, defer, alter, or cancel this Program in part or full, or change any or all the terms and conditions that are applicable, without giving prior intimation/notice of any kind and will not be liable for any consequential losses/damages. Any decision of MARS INTERNATIONAL INDIA PVT. LTD. in this regard and in general with respect to this Program and the terms and conditions thereto shall be final, binding, and non-negotiable.
- Nothing contained herein amounts to a commitment or representation by MARS INTERNATIONAL INDIA PVT. LTD. to conduct further Programs.
- The decision of MARS INTERNATIONAL INDIA PVT. LTD. shall be final in all regards and no communication shall be entertained in this regard. None of the provisions of these Terms and Conditions shall be deemed to constitute a partnership or Partner Agency between any Participant and MARS INTERNATIONAL INDIA PVT. LTD. and the Participant shall not have the authority to bind MARS INTERNATIONAL INDIA PVT. LTD. in any manner whatsoever
- MARS INTERNATIONAL INDIA PVT. LTD. or any of its respective officers/employees/directors shall not be responsible for delayed, lost, mutilated, corrupted or illegible documents etc.
- MARS INTERNATIONAL INDIA PVT. LTD. Or its Agency shall not be liable to perform any of its/their respective obligations under the Program or in respect of the prize where it is unable to do so because of circumstances beyond its/their control in the nature of fire, explosions, natural calamities, state emergency, riots, or any other Force Majeure condition, etc., and shall not be liable to compensate the Participant in these circumstances.
- MARS INTERNATIONAL INDIA PVT. LTD. or it’s Agency shall not be accountable/liable for any disruptions/stoppages/interruptions or cancellation of the Program due to any government restrictions.
- Failure to exercise or delay in exercising a right or remedy provided hereunder or by law does not constitute a waiver of the right or remedy or waiver of other rights or remedies on the part of MARS INTERNATIONAL INDIA PVT. LTD. or its Agency.
- MARS INTERNATIONAL INDIA PVT. LTD. or its Agency accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, loss of SMS, loss of internet connectivity, unique codes, documents, demand drafts, claims or correspondence whether due to error, omission, alteration, tampering, unauthorized data hacking, deletion, theft, destruction, virus attack, transmission interruption, communications failure, hardware failure or otherwise. MARS INTERNATIONAL INDIA PVT. LTD. or it’s Agency shall not be liable for any consequences of user error including (without limitation) costs incurred.
- If a Participant is dissatisfied with the Program or the Program rules and/or any content or any requirements of the Program form, the materials available related thereto, or with these terms and conditions, his/her sole and exclusive remedy is to not participate in the Program.
- If a person chooses to access the Program Website from outside India, he/she shall do so on his/her own initiative and shall be responsible for compliance with applicable local laws of the country.
- The participation in the Program is purely voluntary and the same shall be construed as an acceptance of the terms and conditions stipulated herein.

- The Program is subject to the guidelines/directions issued by the Telecom Regulatory Authority of India, Department of Telecommunications, and any governmental or statutory authority as may be applicable from time to time.

- The Agency is not responsible for Non-Delivery or receipt of an SMS by their servers or on the end user’s device due to customer handset issues, network issues or due to any issues at cellular operator’s end. By participating in this program, the customer understands that all such queries are to be directed to their current service provider directly and not hold Agency or MARS INTERNATIONAL INDIA PVT. LTD. responsible for the same.
Terms & Conditions zomato:
- This Offer is valid on all days of the week. Offer valid at select restaurants only.
- In the event orders are fully cancelled (during & outside the Offer Period), the corresponding instant savings applicable on that order/transaction will not be granted.
- This Offer can neither be combined with any other offer nor can it be transferred or assigned to any other Customer or third party.
- zomato reserves the right to cancel/change/modify/add/delete any of the terms and conditions of the offer at any time after mutual discussions.
- zomato reserves the right to deny honoring the offer on the grounds of suspicion or abuse of the offer by any customer without any explanation thereof.
- In no event shall zomato be liable for any abuse or misuse of the code due to negligence of the customer.

- The transactions for any approved claim of refund/replacement shall be excluded from this Offer.
- zomato holds no warranty and is not representative of the delivery, services, suitability, merchantability, availability or quality of the products made available to Customer by Qwikcilver under the respective Offer.
- The Customers shall not hold zomato, its group entities, or affiliates, their respective directors, officers, employees, agents, vendors, responsible for or liable for, any actions, claims, demands, losses, damages, personal injury, costs, charges and expenses which a Customer claims to have suffered, sustained or incurred, or claims to suffer, sustain or incur, directly or indirectly, by way of and/or on account of participating in the Offer or the acceptance, decline, non-receipt, suitability, quality or by use or non-use or suitability or effectiveness of the products/services .
- zomato is not liable or responsible for any claim(s), dispute(s) regarding delivery, service, suitability, merchantability, availability, quantity or quality (if any) made available to the Customers under the Offer on the products/services (shortly referred as “Claims”).
- Any query/ contention/dispute raised by any Customer to zomato for the services provided by Qwikcilver, shall be forwarded to Qwikcilver who shall be solely responsible for resolving such queries/ contentions/disputes within reasonable time.
- Qwikcilver and zomato reserve the right to, at any stage and at its discretion, to extend or terminate this Offer, without prior notice or assigning any reasons thereof, to add/alter/modify/change or vary all or any of these terms and conditions or to replace wholly, or in part, this Offer by another Offer, whether similar to this Offer or not, or to extend or withdraw it altogether.
- Neither anything contained in these terms & conditions, nor the running of these Offer to which they apply, shall be construed as an obligation on Qwikcilver or zomato to continue the Offer up to, on or after the Offer termination date. Nothing herein amounts to a commitment or representation by Qwikcilver or zomato to conduct further such Offers.
- The Offer terms & conditions shall be governed by the Laws of India. Any dispute arising out of this Offer shall be subject to the exclusive jurisdiction of competent courts in New Delhi.
- Any taxes or liabilities or charges payable to the Government or any other regulatory authority or body, if any, shall be borne directly by Customer and/or billed to the account of the Customer.
- If the Offer and/or anything to be done by Qwikcilver or zomato or any other entity in respect of the Offer is prevented or delayed by causes, circumstances or events beyond the control of the Parties or any other entity, including but not limited to computer viruses, tampering, unauthorized intervention, interception, fraud, technical failures, floods, fires, accidents, earthquakes, riots, explosions, wars, hostilities, acts of government or other causes of like or similar or other character beyond the control of Qwikcilver or zomato or the other entity/ies, then Qwikcilver and/or zomato and/or the other entity/ies shall not be liable for the same to the extent so prevented or delayed, and will not be liable for any consequences.
- zomato shall in no way be liable if any Customer is unable to login to zomato app or website due to incompatibility of device, internet usage plans, or any other reason whatsoever.
- Customers are not bound in any way to participate in this offer. Such participation is voluntary and is deemed as acceptance of the terms and conditions mentioned herein. By participating in the offer, the Customers agree to be bound by the terms & conditions contained herein. Without a Customer being required to do any further act, he/she shall be deemed to have read, understood and unconditionally accepted the terms & conditions herein. The Offer Terms & Conditions need to be read in conjunction with the detailed zomato Terms & Conditions available on the website.
- Any query regarding the offer will be entertained till 15th September 2021. Post such date, zomato or Qwikcilver will not entertain any correspondence or communication regarding this Program from any customers/persons.
- Cashback will be credited on successful transactions only
- Cashback will be credited within 48 hours post transaction
- Cashback, once credited, will be valid for 72 hours
Release and Limitations of Liability:
- MARS INTERNATIONAL INDIA PVT. LTD. and its Agency shall under no circumstances be liable, whether jointly or severally, for any loss or damage suffered or sustained (including but not limited to consequential loss), including for personal injury or property damage suffered or sustained, because of acceptance of any prize.
- By entering the Program, the Participant hereby releases from and agrees to indemnify MARS INTERNATIONAL INDIA PVT. LTD. and/ or any of its respective officers/employees from and against all liability, cost, loss, or expense arising out of acceptance of the prize or participation in the Program including (but not limited to) personal injury and damage to property and whether direct, indirect, consequential, foreseeable, due to some negligent act or omission, or otherwise.
- MARS INTERNATIONAL INDIA PVT. LTD. and its Agency accept no liability, whether jointly or severally, for any errors or omissions, whether on behalf of itself, Agency or third parties in relation to the prizes.
- The Participant shall be solely responsible for any consequences which may arise due to his/her participation in the Program by conducting an illegal act. Participant also undertakes to indemnify MARS INTERNATIONAL INDIA PVT. LTD. and/or its Agency and their respective officers, directors, employees, and agents on the happening of such an event (including without limitation cost of attorney, legal charges etc.) on full indemnity basis for any loss/damage suffered by MARS INTERNATIONAL INDIA PVT. LTD. or its Agency on account of such act on the part of the Participant.
- In consideration of MARS INTERNATIONAL INDIA PVT. LTD. allowing the Participant/s to take part in the Program, to the maximum extent permitted by law, the Participant/s waive and release each and every right or claim, all actions, causes of actions (present or future) each of them has or may have against MARS INTERNATIONAL INDIA PVT. LTD. its respective agents, directors, officers, business associates, group companies, sponsors, employees, or representatives for all and any injuries, accidents, or mishaps (whether known or unknown) or (whether anticipated or unanticipated) arising out of the Program or related to the Program or the prize of the Program.
Dispute:
- The courts of competent jurisdiction at Delhi shall have exclusive jurisdiction to determine all disputes arising out of, or in connection with, the Program. Participation in the Program is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including (without limitation) this clause.
- Further all issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of the Participants and/or MARS INTERNATIONAL INDIA PVT. LTD. and/or its Agency of this Program, shall be governed and construed in accordance with the laws of the Republic of India.
