These terms and conditions apply to the “Dhara PayTM Cashback Promo” (hereinafter referred to as “Promotion / Offer") for consumers purchasing the Dhara Assure 1 Ltr. worth MRP Rs. 155/- that carries the communication regarding this offer (hereinafter referred to as “Promotion Product") sponsored by Mother Dairy Fruit & Vegetable Pvt. Ltd. and conducted & managed by Qwikcilver Solutions Private Limited (hereinafter referred to as “Organizer”) wherein consumers can avail up to Rs. 40/- cash back on www.Paytm.com and/or PayTm Application on Android or iOS (hereinafter referred to as ‘Website’ and/or PayTM App, respectively) by complying with the following terms and conditions:

• Consumers participating or seeking to participate in the Promotion shall individually be referred to as "Participant" and collectively as "Participants”.
• Participation in this Promotion is purely voluntary and optional. This Offer is not valid in conjunction with any other Offer. Products also available without this Offer. By participating in this Offer, each participant is deemed to have accepted these terms and conditions.
• This Offer is being conducted by the Organizer and sponsored by Mother Dairy Fruit & Vegetable Pvt. Ltd. during the Promotion Period defined hereinafter.
• A Consumer who send the unique code mentioned on the scratch card, between 20.09.2020 to 20.12.2020 (hereinafter referred to as the “Promotion Period”), will stand a chance to get the link for further participation. The complete process on How to Redeem is as below:-

  1. Scratch & find 12-character alpha numeric unique code.
  2. Send 12 character alpha numeric code. Format is DHARA<space>12 Character Alpha Numeric code on 8108590859.
  3. On successful validation of unique code, customer gets instant congratulation SMS with reward amount win.
  4. Within 24 hours, customer will receive 2nd SMS along with the link & Participation code with 7 days validity.
  5. Customer will click on link, select Denomination, Fill First Name, Last Name, Mobile Number & Participation code and Submit.
  6. Post verification, customer will get Paytm code via SMS
  7. Process to redeem promo code: -
     • Open Paytm App
     • Tap on Add Money
     • Put Amount & click on “Have a Promocode”
     • Enter Promocode & Apply to Proceed.

• This Offer is valid only in India. The Offer is valid for the citizens of India (except the employees and family members of the Organizer and Mother Dairy Fruit & Vegetable Pvt. Ltd., their associate companies, their joint venture partners, its co-packers, their distributors, their agents, their advertising and promotional agencies and their auditors.)
• Paytm cashback is the term used to define Paytm cash that Participant gets when he/she applies the code on the Website and/or the PayTM APP. No cash would be given in lieu of Paytm cash.
• Each unique code can be used only once to redeem the Cashback.
• This Offer can be availed only 1 times by each Participant using a single PayTM Account during the Promotion Period. Any Participant, using a Code more than 1 times from a single PayTM Account, will not be eligible for availing the PayTM Cashback.
• The Code cannot be redeemed after the expiry of the Promotion Period and the participant by participating in the Promotion agree to waive off right of redemption post the date of expiry of the Promotion Period.
• In case of any conflict between terms and conditions printed on the pack/insert/voucher and these Terms and Conditions on https://www.woohoo.in/dhara website, the terms and conditions printed on https://www.woohoo.in/dhara website shall prevail.
• Paytm cashback offered as part of this Offer is non-transferrable, non-refundable; and no physical cash payment will be made in lieu of this. At any stage, Mother Dairy Fruit & Vegetable Pvt. Ltd. and/or Organizer reserve their right to call upon the Participant to submit any document for verification of identity as per its sole discretion.
• Mother Dairy Fruit & Vegetable Pvt. Ltd. will not be liable for any delay in actual redemption under this Offer reflecting in the customers’ account.
• Organizer and Mother Dairy Fruit & Vegetable Pvt. Ltd. will not be responsible for any loss or damage to the Code due to wrong opening of the pack.
• Under this Promotion, the vouchers are being offered directly by the Organizer. Mother Dairy Fruit & Vegetable Pvt. Ltd. is not responsible either directly or indirectly with respect to any matter pertaining to this Voucher and the prize offered with this Voucher.
• Mother Dairy Fruit & Vegetable Pvt. Ltd. does not endorse the quality of any of the products or services being offered by the Organizer. • At any time, the Organizer and/or Mother Dairy Fruit & Vegetable Pvt. Ltd. reserves the right to update and/or amend all or any of these terms without further notice.
• Mother Dairy Fruit & Vegetable Pvt. Ltd. and/or Organizer reserves the right to cancel, change or substitute Offer at any time without any prior notice.
• The Participant/s undertake and irrevocably and unconditionally permit Mother Dairy Fruit & Vegetable Pvt. Ltd. and/or the Organizers to cover the Promotion through various media including newspapers, radio television news channels, internet, point of sale materials, etc., and shall not raise any objection, protest or demur to such coverage or in this regard.
• The winners must, at the request of Mother Dairy Fruit & Vegetable Pvt. Ltd. and/or the Organizers participate in all Promotion related activities (such as publicity and photography) surrounding the winning of the Prizes, free of charge, and they consent to the Organizers using their name and image in the Promotion material.
• All rights, title and interest, including but not limited to the Intellectual Property Rights, in the Promotion material(s) and in any and all responses received shall vest with Mother Dairy Fruit & Vegetable Pvt. Ltd. and or its partners respectively. Mother Dairy Fruit & Vegetable Pvt. Ltd. or any person or entity permitted by Mother Dairy Fruit & Vegetable Pvt. Ltd. in this regard shall be entitled to use the responses received or any information in connection with the entry in any media for future Promotion, marketing, publicity and any other purpose, without any permission and or payment to the Participant.
•  All material submitted in connection with the Promotion (whether written, audio, electronic or visual form, or a combination of those) or any photographs, video and/or film footage and/or audio recording taken of Participants are assigned to Mother Dairy Fruit & Vegetable Pvt. Ltd. upon submission and become the property of Mother Dairy Fruit & Vegetable Pvt. Ltd. exclusively. Mother Dairy Fruit & Vegetable Pvt. Ltd. may use the material in any medium in any reasonable manner it sees fit. Copyright in any such material remains the sole property of Mother Dairy Fruit & Vegetable Pvt. Ltd.
• By participating in the Promotion, Participant(s) confirms to waive the applicability of rules and regulations of the National Do Not Call Registry (hereinafter referred to as “DND”) and agree and give their consent to be contacted by Mother Dairy Fruit & Vegetable Pvt. Ltd. and/or the Organizers for the purposes of this Promotion In case the customer finds a Promotion Product pack without code and files a complaint for the same or approaches the company with this complaint. In that case Mother Dairy Fruit & Vegetable Pvt. Ltd. and/or the Organizers liability would be limited to providing the complainant with a new promo Code to enable him to participate in the Promotion as per this Terms and Conditions. The Participant cannot demand any monetary or other compensation for the same.
• Organizer/ Mother Dairy Fruit & Vegetable Pvt. Ltd. accept no responsibility for any tax implications that may arise from the offer. Participants will have to bear incidental costs, if any, that may arise for redemption of the prize.
• Paytm is the registered trademark of ONE97 & Dhara is the registered trademark of Mother Dairy Fruit & Vegetable Pvt. Ltd.
• Mother Dairy Fruit & Vegetable Pvt. Ltd. and/or Organizers shall not be responsible for any loss, injury or any other liability arising out of the Promotion or due to participation by any person in the Offer.
• Mother Dairy Fruit & Vegetable Pvt. Ltd. and/or Organizers shall not be responsible for downtime on the services, caused due to technicalities (like failure of hardware equipment, configuration issue, network congestion), or due to decisions/changes in regulations that are carried out by TRAI, RBI, DoT or any other regulatory body.
• Participant agrees that use of this Offer is at his/her sole risk. Mother Dairy Fruit & Vegetable Pvt. Ltd. and/or the Organizer, their affiliates, and their officers, directors, employees, and agents disclaim all warranties, express or implied, including without limitation any warranty of merchantability, availability, and fitness for a particular purpose or non-infringement.
• The Organizers and /or Mother Dairy Fruit & Vegetable Pvt. Ltd. shall not be liable to perform any of its/their respective obligations under the Promotion or in respect of the Cashback where it is unable to do so as a result of circumstances beyond its/their control in the nature of fire, explosions, natural calamities, state emergency, riots, or any other force majeure condition, etc. and shall not be liable to compensate the Participant in these circumstances. The Organizers and/or Mother Dairy Fruit & Vegetable Pvt. Ltd. shall not be accountable/liable for any disruptions/stoppages/interruptions or cancellation of the Promotion due to any government restrictions.
• Failure to exercise or delay in exercising a right or remedy provided hereunder or by law does not constitute a waiver of the right or remedy or waiver of other rights or remedies on the part of the Organizers and Mother Dairy Fruit & Vegetable Pvt. Ltd..
• If a Participant is dissatisfied with the Promotion or the Promotion rules and/or any content or any requirements of the Promotion form, the materials available related thereto, or with these terms and conditions, his/her sole and exclusive remedy is to, not participate in the Promotion.
• The Organizers and Mother Dairy Fruit & Vegetable Pvt. Ltd. shall under no circumstances be liable, whether jointly or severally, for any loss or damage suffered or sustained (including but not limited to consequential loss), including for personal injury or property damage suffered or sustained, as a result of participation in the Promotion.
• By entering the Promotion, the Participant hereby releases from and agrees to indemnify the Organizers and Mother Dairy Fruit & Vegetable Pvt. Ltd.  from and against all liability, cost, loss or expense arising out of participation in the Promotion including (but not limited to) personal injury and damage to property and whether direct, indirect, consequential, foreseeable, due to some negligent act or omission, or otherwise.
• The Participant shall be solely responsible for any consequences which may arise due to his/her participation in the Promotion by conducting an illegal act. Participant also undertakes to indemnify Mother Dairy Fruit & Vegetable Pvt. Ltd./the Organizers and/or their respective officers, directors, employees and agents on the happening of such an event (including without limitation cost of attorney, legal charges etc.) on full indemnity basis for any loss/damage suffered by the Organizers and/or Mother Dairy Fruit & Vegetable Pvt. Ltd. on account of such act on the part of the Participant.
• In consideration of  the Organizers and Mother Dairy Fruit & Vegetable Pvt. Ltd. allowing the Participant/s to take part in the Promotion, to the maximum extent permitted by law, the Participant/s waive and release each and every right or claim, all actions, causes of actions (present or future) each of them has or may have against the Organizers and/or Mother Dairy Fruit & Vegetable Pvt. Ltd., their respective agents, directors, officers, business associates, group companies, sponsors, employees, or representatives for all and any injuries, accidents, or mishaps (whether known or unknown) or (whether anticipated or unanticipated) arising out of the Promotion.
• The terms and condition of this Offer shall be governed by Indian Laws. The Courts at Delhi shall have the exclusive jurisdiction in respect of all the subject matter with relation to the Offer.
• Any costs associated with entering the promotion, including but not limited to accessing the promotional website, SMS charges to enter the promotion, Call Charges, or Data Charges are the responsibility of each Participant. The Participant may be charged by their respective telecom operator as per their nominated tariff plan.
